Hello everyone!

As some of you might have seen it on our Amplified stream schedules this year we will hold a fundraising for the non-profit Earthjustice. 

We have specific stretch goals tied to this fundraising and some of them have actual rewards that will require us to hold a raffle among the donors.
So in case you are interested, here is the actual Terms and Conditions for you to know how to be taken into account in this raffle and get your chance to win one of the prizes if they are unlocked during Amplified!  

How to enter the Rewards Raffle

Registration for the Raffle will open on 18 January 2023, 09:00am GMT and will require players to complete the entrance requirements set out in the Raffle Requirements below (“Participants”, “You”, or “Your”) on the AmplitudeStudios Twitch (the channel), taking place on the Twitch platform for the special Amplified 2023 event (the “Event”). Participants will also need to read and understand the data privacy practices contained in SEGA Europe Limited’s Privacy Policy (Privacy Policy). Personal Data (defined below) that you are requested to provide to SEGA as a Participant or Winner of the Competition shall be controlled and processed by SEGA. Any questions, comments, or complaints regarding the Challenge must be directed to SEGA at: community@amplitude-studios.com.

The Challenge shall be open for participation by eligible Participants from 09:00AM GMT on 18 January 2023 to 8:00PM GMT on 20 January 2023 (the “Challenge Period”). 

To participate in the Challenge, eligible Participants will need to complete the following steps (the “Challenge Details”): 

• Having donated at least $5 to the fundraiser held on the Amplitude Studios livestream channel on Twitch; 

• Each $5 donated count as one entry, so if people donate $15 it would count as 3 entries for them; 

• If selected, the winner will be contacted via Twitch DM by the Amplitude Studios channel. If they do not answer in the 7 days following the initial reach out, they will be disqualified as the winner and another person will be selected.     

Twitch: If you do not have a Twitch account, create your free account at https://www.twitch.tv/. Message, data rates or other charges may apply if you are participating via the use of a smart mobile device; check your mobile plan for rates and details. Participation may not be available on all carriers. You must adhere to any rules and policies of Twitch when using your Twitch Account and entering the Challenge. Please see https://www.twitch.tv/p/ro-ro/legal/terms-of-service/. Twitch may take action against any participants that violate its policies. SEGA takes no responsibility for the actions of Twitch, the Twitch site or the Twitch Account used by Participants.

Eligibility 

To be eligible for the Challenge, You must: 

1. Have donated at least $5 to the Earthjustice fundraising set up on the Amplitude Studios Twitch Channel (using the Twitch Charity Tool). 
2. Be 18 years of age or older at the time of entry; 
3. Maintain and operate a valid e-mail and Twitch account; 
4. Not be the subject of, or legally resident in any countries under sanction by the Office of Foreign Assets Control (“OFAC”) of the U.S. Department of the Treasury. The most up-to-date list of sanctioned countries and persons is located at: https://www.wm.edu/offices/techtransfer/ExportControls/Regulations/OFAC/index.php.

Participation shall be void anywhere it is prohibited by law, irrespective of the Eligibility requirements set out above. Any Participant who is not eligible for the Challenge shall be disqualified at the entire discretion of the Promoter.  If proof of age is requested, and if satisfactory proof of age is not received, the Promoter reserves the right to choose another winner.

Prizes

A maximum of fifteen (15) Winners shall be randomly selected from all eligible Participant entrants by the Promoter at the end of the Challenge Period, the number of winners will depends on the amount gathered during the fundraising, as those rewards are tied to specific stretch goals getting reached. Each Participant is eligible for at most one prize. 

The Prizes shall consist of: 

• One (1) printed and signed artwork from Endless Dungeon Art Team (unlocked once we reach a raised total of $100); 

• Five (5) digital and personalized avatars made by Chapel Comics (unlocked once we reach a raised total of $350); 

• Three (3) boxes containing merch tied to Humankind and the Endless Universe (each box will have around $100 in value) (unlocked once we reach a raised total of $1,000); 

• One (1) of the donor will get to work with us on the name of an NPC in one of our future game (unlocked once we reach a raised total of $1,300);

• Five (5) printed and signed artwork from the Endless Dungeon Art Team (unlocked once we reach a raised total of $1,675).
  
  

Retrieving the prizes:

The Winners will be contacted using Twitch Direct Messaging to ask them for the relevant information to receive their prizes (emails/full names/addresses/phone numbers) within five (5) business days of the determination by the Promoter. The Winner will have seven (7) business days to respond to the prize notification direct message with the requested information to deliver the Prize. Failure to respond within this timeframe will result in disqualification and the selection of an alternate Winner at SEGA’s sole discretion.
Return of prize notification e-mail as undeliverable will result in disqualification and the selection of an alternate Winner. All decisions of the Promoter are final. For the avoidance of doubt, this is an indication of approximate times only and the Promoter shall not be liable if the prize draw an/or the announcement of the Winners is delayed.  

General

1. ANY AND ALL TAX LIABILITY RESULTING FROM A WINNER'S RECEIPT OF THE PRIZE IS THE RESPONSIBILITY OF THE WINNER. There is no prize transfers or prize substitutions available. In the event of unavailability of the prize or prize components, the Promoter reserves the right to substitute a prize or prize component with that of equal or greater value. 

2. Promotor reserves the right to discontinue this Challenge at any time and without notice following the conclusion and complete fulfilment of all prizes associated with the Challenge. In the event of a dispute regarding the identity of the person submitting the winning entry, the Prize will be awarded to the authorized Twitch account holder regardless of the individual who submitted the entry. The authorized account holder is the natural person who is assigned to the Twitch address used to enter the Challenge. The Promoter reserves the right to void entries, which in its sole determination, are irregular or have been generated with abusive and/or duplicitous intent including but not limited to false or multiple Twitch accounts.  

3. By entering, you (a) agree to comply with and be bound by the official rules and the decisions of the Promoter which are final and binding in all respects; (b) agree to release Promoter and its employees and agents from any and all liability, loss, damage or injury resulting from participation in this Challenge or from the awarding, receipt, possession use and/or misuse of any Prize; (c) acknowledge that the Promoter and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; and (d) consent to the use of your name and any other information requested by the Promoter (including but not limited to photograph and/or likeness, statements and/or voice) for advertising and promotional purposes in all media worldwide and in perpetuity without additional compensation, unless prohibited by law. 

4. The use of any automated technique ("Automated Cheats") to enter the Challenge is prohibited. SEGA has the right to invalidate any entry if its sole opinion the Participant has engaged in the use of Automated Cheats at any time.  All decisions of SEGA are final.

5. SEGA is not responsible for any lost, late, delayed, misdirected, garbled, illegible, incorrect or inaccurate information or entries that are misdirected or misrouted as a result of interrupted or unavailable network connections or internet transmissions for any reason, or any failure of the website during the Challenge Period, or for any computer, phone, phone line hardware or software malfunction, failure or error of any kind, whether mechanical, human or electronic. Any attempt by a Participant to interfere with the operations of this Challenge is a violation of criminal and civil laws; SEGA reserves the right to seek damages from any such Participant to the fullest extent permitted by law. If, for any reason, any Challenge is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of SEGA which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Challenge, SEGA reserves the right at its sole discretion to cancel, terminate, modify or suspend the Challenge and select winners in a random drawing from among all eligible entries received prior to the cancellation. All entries (and the content therein) become the property of the SEGA upon submission. 

6. Participants agree that they may be required to take part in publicity without further consent or payment. Such publicity may include the public promotion of their names and/or likeness.

Release

BY PARTICIPATING IN THIS CHALLENGE, YOU RELEASE AND HOLD AMPLITUDE,  ITS PARENT COMPANY OR COMPANIES, SUBSIDIARIES, AFFILIATES, DISTRIBUTORS, RETAILERS, ADVERTISING AGENCIES AND EACH OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES, HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH THE CHALLENGE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF, OR DEFECTS IN, A PRIZE, OR PARTICIPATION IN THE CHALLENGE, WITHOUT LIMITATION CLAIMS BASED ON PROPERTY LOSS OR DAMAGE, PUBLICITY OR PRIVACY RIGHTS, AND/OR DEFAMATION. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT THE PROMOTER’S LIABILITY FOR PERSONAL INJURY OR DEATH CAUSED BY ITS NEGLIGENCE.

Law and Jurisdiction

These terms are governed by the laws of England and Wales and any claim or matter arising out of these terms shall be subject to the jurisdiction of the courts of England.

Data Protection 

In order to participate in the Challenge, participants may need to provide certain information on themselves, such as the Participant’s name, email address and country of origin. Your entry may also contain certain personal data (e.g., Steam ID) and you may be required to submit a photograph or video of yourself if this forms part of the entry requirements for the Challenge. Winners of the Challenge may be required to provide their full address for the purpose of SEGA delivering any applicable Prize (together, “Personal Data”).    

This Personal Data is collected and processed only for the purposes of organising, running, and monitoring the Challenge, as well as for carrying out publicity activities relating to the Challenge and SEGA promotions in general. By entering this Challenge, participants agree  that they have read and understood SEGA’s Privacy Policy (Privacy Policy), and any privacy policy which applies for any other third party whose services are used for the purposes of the Challenge (for which SEGA is not responsible) and agreed to be bound by any other requirements determined by SEGA, which may be amended or varied at any time by the Promoter.
