Not always^^ You'll see that sometimes, even if you're defending, your fleet warps in the system and the ennemy is waiting for you XD
I hadn't even thought about this before, but that makes total sense. Right now the only way you can tell is that the Fleet that attacks is the one that's already "in system" when the combat starts. The one that warps in is the one that is defending (which seems backwards, but...).
As you say, somehow getting your faction's color onto the ships somehow would be a nice touch.
